After an accident that was not your fault, the other side owes the restoration of the condition that would exist without the accident. In full, not approximately. That is § 249 BGB, and the reason why the expert report, the lawyer and our work are not billed to you but to the insurer of the at-fault party.
The opposing insurance is not a neutral arbiter in this. It represents its own customer. Insisting on your rights is therefore not a fight, it is the normal course of things.
