What is really behind it

1. Anchor-setting as a negotiation tactic

Psychological research (Tversky/Kahneman) shows: once a concrete figure is on the table, negotiations typically revolve around that figure. Starting at €1,500 lands you at €2,000 or €2,500 — not at €6,000, which may well be the appropriate amount.

2. Bypassing the Hacks/Wellner table

The Hacks/Wellner pain-and-suffering table is the recognised standard reference of German courts for assessing Schmerzensgeld. Insurers' initial offers typically sit at the lower end of — or below — the Hacks/Wellner ranges. Anyone unfamiliar with the table will not notice the gap.

3. Exploiting the information asymmetry

Insurers know the relevant judgments; injured parties do not. Anyone who does not engage a lawyer negotiates blind against an experienced claims handler with database access.

4. Excluding late-onset consequences

Under the BGH's established line of authority, Schmerzensgeld serves two functions:

  • Compensatory function — material compensation for pain and impairment

Hacks/Wellner table as the courts' standard reference

The annually updated Hacks/Wellner pain-and-suffering table (C.H. Beck Verlag) collects German Schmerzensgeld judgments and organises them by injury type. It is an orientation point, not a ceiling — in cases of particular severity, awards can exceed the tabulated values.

Since the 2010s, German courts have recognised a consistent upward trend in Schmerzensgeld ranges — particularly for psychological sequelae such as PTSD or chronic pain syndromes.

Never accept an insurer's initial offer without legal review. Statistically, the appropriate Schmerzensgeld for moderate to severe injuries is often 3 to 5 times the insurer's opening figure.

Response A — Blanket increase

Your response: If the increase is still too low, reject it. Present specific comparable judgments. Signal readiness to litigate.

Response B — Litigation-risk threat

"In court proceedings, you could end up with less."

Your response: With a clear factual basis and Hacks/Wellner ranges on your side, the litigation risk is manageable. Your lawyer will assess.

Response C — Rejecting late-onset consequences

"We assume no late-onset consequences will arise — hence a blanket settlement."

Your response: A reservation for late-onset consequences is non-negotiable. If refused: no settlement, proceed to litigation.

Response D — Negotiation fatigue

"These negotiations have been going on for a long time — time for a decision."

Your response: This is an insurer tactic. Take a break, speak to your lawyer, and do not accept out of exhaustion.


Frequently asked questions

Is €1,500 Schmerzensgeld adequate for a HWS-Distorsion? Only for grade I (minor symptoms, short recovery). For grade II, the typical range is €800–3,500; for grade III, €3,000–10,000. The precise assessment depends on the medical diagnosis, treatment duration and consequences.

How much Schmerzensgeld can a lawyer achieve? Statistically, 2 to 5 times the insurer's initial offer. Concretely: with documented Hacks/Wellner references and readiness to litigate, 60–80% of the upper end of the table range is realistic.

What if the insurer says "final offer"? Standard pressure tactic. "Final offer" has no legal meaning. If the amount is still too low: file suit — the insurer pays your legal costs.

Can I claim Schmerzensgeld for psychological consequences too? Yes. PTSD, adjustment disorders and driving anxiety are independently compensable under § 253 BGB. Ranges: €2,000–60,000 depending on severity and chronification.

Do my financial circumstances play a role? Rarely. Only in exceptional cases — very low-income injured parties or very high-net-worth at-fault parties — are financial circumstances factored into the assessment.
