    Against ControlExpert/K-Expert reductions, the partner law firm responds with reference to BGH VI ZR 65/18 (UPE), VI ZR 174/24 (blending/respray), VI ZR 38/22 ff. (workshop risk). Court proceedings before the competent Landgericht if necessary — the opposing party pays.

    In cases of reductions or disputes it may take longer — you can see the status at any time, and your advisor stays in the loop. What happens in the first days after an accident determines the value of your claim. These seven mistakes cost money in practice most often — all avoidable with the right sequence of steps.

    Engaging with the opposing party's claims management

    Why: "We'll take care of everything" means: claims steering to a partner workshop, no independent expert, no diminished value — typically 30–40% less in entitlements due to audit-service reductions (NDR investigative report 2022, Verbraucherzentrale, BGH VI ZR 38/22 ff.).

    Accept the insurance company's appraiser

    Why: "Who pays the piper calls the tune." — Insurance appraisers systematically underestimate damage. Examples: €2,000 instead of €9,000 after dismantling.

    Why: In a subsequent second accident at the same location, without proof of repair the insurer can refuse settlement entirely (HIS file).

    Better: Two-photo rule: photograph the vehicle after repair with a dated newspaper in the frame. One wide shot and one close-up of the repaired area.

    Fail to secure video evidence immediately

    Why: Security cameras at petrol stations, car parks, and shops typically overwrite recordings after 3–4 weeks. Request too late and the evidence is gone.

How quickly is the first callback?

Within 15 minutes during business hours — 08:00 to 20:00. Outside those hours, the next working day morning. You can write via WhatsApp at any time.

Do I have to speak to the opposing insurance?

No — and you shouldn't. As soon as you report your claim with us, our partner law firm for traffic law takes over all communication. If the opposing insurance contacts you directly: simply forward it to us.

What happens if the insurance rejects my expert report?

That happens frequently. ControlExpert / K-Expert produce audit reports without inspecting the vehicle and systematically reduce UPE, transport costs, and Wertminderung (diminished value). Our partner law firm for traffic law responds with BGH references (VI ZR 65/18, VI ZR 174/24, VI ZR 38/22 et seq.) and recovers the deductions in full. If necessary through litigation — the opposing party also pays the legal and court costs.

Can I track progress myself?

Yes, live in the Claimondo portal: the expert's location, status of the repair estimate, incoming insurance responses, projected payment date. Also available as a mobile app with push notifications on every status change.

Do I need to pay anything upfront?

No. Sicherungsabtretung under §398 BGB transfers the claim for the expert's fee directly to the appraiser — who settles with the insurance. Repair via the workshop works the same way. In a no-fault accident you pay €0 out of pocket (under §249 BGB, subject to acknowledgement by the opposing liability insurer).

What if I don't live in NRW?

No problem. Our main focus is NRW, but the partner network covers 72 major German cities — Berlin, Hamburg, Munich, Frankfurt, Stuttgart, Hannover, Leipzig, Dresden, Bremen, Kiel and more. City pages with local Landgericht / bar association / BVSK-Honorartabelle range at /kfz-gutachter/<stadt>.
