"No Diminished Value Has Occurred" – Decoder

In brief: Insurers deny Wertminderung (diminished value) using three standard arguments — vehicle too old, minor damage, repair carried out professionally. The frequently cited rule of thumb "no diminished value after 5 years and 100,000 km" is not a binding threshold but an orientation value. Under BGH case law, Wertminderung is an independent damage claim that must be assessed on a case-by-case basis — high-value vehicles or well-maintained models can remain eligible for diminished-value claims well beyond these limits.

What You Have Just Received — Verbatim

Typical variations:

"No Wertminderung (diminished value) applies to your vehicle given its age of [X] years and mileage of [Y] km."

"The repair was carried out professionally — no diminished value is apparent."

"This is a minor (Bagatell) damage — Wertminderung does not apply."

"Our appraiser sees no diminished value."

Three recurring lines of argument:

  • Rule-of-thumb argument: "No diminished value after 5 years / 100,000 km"
  • Minor-damage argument: "Damage too small"
  • Professional-repair argument: "The repair fully compensates for the loss in value"

All three are not sustainable as blanket grounds for refusal under BGH case law.

What Is Really Behind This

1. Eliminating a damage position as a mass operation

Wertminderung typically amounts to €500–€3,000 per case for mid-range vehicles. Blanket refusals are highly profitable when accepted without objection — insurers deliberately calculate on a high acceptance rate.

2. Misuse of the rule of thumb

The frequently cited thresholds of "5 years / 100,000 km" originate from older appraiser conventions. BGH case law rejects a rigid age limit — what matters is the individual assessment of the specific vehicle on the specific market.

3. Artificially raising the minor-damage threshold

Insurer letters routinely place the minor-damage (Bagatell) threshold at €3,000 or higher. Under BGH case law it typically sits at €500–€1,500 — below that, Wertminderung is generally minimal but not necessarily zero.

4. Insurer appraiser sets a low figure

Where Wertminderung is not flatly refused, the insurer's appraiser sets it significantly lower than an independent expert would — differences of 50% to 200% are observed in practice.

What Case Law Says

Wertminderung as an independent damage position

The BGH recognises Wertminderung in consistent case law as an independent damage position under § 249 BGB (German Civil Code on damage compensation). It arises from the fact that a vehicle declared as "accident-damaged" achieves lower prices on the used-car market — even after a fully professional repair.

Requirements

Three conditions must be met:

  1. Professional repair of the accident damage
  2. Significant damage — above the minor-damage threshold
  3. Loss of market acceptance — a measurable loss in value

No rigid age limit

The practical rule of thumb "up to 5 years and 100,000 km" is not a BGH standard but an appraiser orientation rooted in tradition. High-value premium vehicles or well-maintained models can give rise to a Wertminderung claim beyond these thresholds — individual assessment decides.

Calculation methods in the expert report (Gutachten)

Recognised methods for calculating Wertminderung are:

  • Ruhkopf-Sahm method (classic, widely used)
  • Halbgewachs method
  • Modified Frankfurt Method (MFM)
  • Berens-Hettberg-Strunk method

Each method follows a different calculation logic. The chosen method must be substantiated in the Gutachten.

Typical ranges (orientation)

Damage amountWertminderung range
Under €1,500usually €0 (minor-damage range)
€1,500 – €5,000€200 – €700
€5,000 – €15,000€500 – €2,000
Over €15,000€1,500 – €5,000

→ These figures are orientation values, not rules. Structural damage, premium vehicles, or special circumstances can justify significantly higher Wertminderung claims.

What You Do Now — Concretely

💡 The most important rule

Your own independent appraiser (Sachverständiger) is non-negotiable. Their Gutachten contains the Wertminderung calculation — without it you have no defensible position against the insurer's refusal.

🛠 Four steps

1. Gutachten with Wertminderung calculation Instruct a BVSK-certified Sachverständiger — the Wertminderung must be explicitly quantified, with the method named.

2. Counter the rule-of-thumb argument For a young or well-maintained vehicle: cite service history, brand-authorised servicing, and premium-model arguments in writing.

3. Concrete minor-damage assessment State the exact damage amount. With damage above €1,500 the minor-damage argument typically does not hold.

4. Litigation where the difference exceeds €500 Where the insurer refuses or significantly undervalues the claim, legal escalation by our partner law firm is worthwhile. Legal costs are borne by the insurer.

Letter Template — Enforcing Wertminderung

Dear Sir or Madam,

I refer to your refusal of the Wertminderung (diminished value)
in claim [claim number].

I reject your blanket refusal. The following facts substantiate
the Wertminderung claim:

1. Damage amount: [X] € — not a minor (Bagatell) damage
2. Vehicle: [make, model, year, km] — within the typical
   Wertminderung-relevant range; continuous brand-authorised
   servicing (service booklet enclosed)
3. My Sachverständigen-Gutachten (expert report) determines a
Wertminderung of [Y] € using the [method, e.g.
   Ruhkopf-Sahm] method (see enclosed Gutachten)

Under consistent BGH case law, Wertminderung is an independent
damage position. The rule of thumb "5 years / 100,000 km" is
not an absolute threshold but depends on individual assessment.

I request full reimbursement of the Wertminderung of [Y] €
within 4 weeks.

Upon expiry of this deadline you will be in default under
§ 286 BGB.

Yours sincerely,
[Signature]

What the Insurer Will Likely Do Next

Response A — "Our appraiser sees less"

"Our appraiser sees a maximum of €200 in Wertminderung."

Your response: Demand a methodology comparison. Your own Gutachten carries equal weight. In the event of a dispute, a court-appointed appraiser decides.

Response B — Sharpening the age argument

"At 7 years of age, Wertminderung is excluded."

Your response: BGH case law on individual assessment. Premium brand / good condition / full service history are valid arguments against a rigid age threshold.

Response C — Shifting the minor-damage threshold

"No Wertminderung applies to damages under €3,000."

Your response: BGH case law on the minor-damage threshold. It sits typically at €500–€1,500, not €3,000. Cite the specific extent of damage (structural damage vs. paint damage is a significant distinction).

Response D — Prior damage argument

"The vehicle already had prior damage — no additional Wertminderung."

Your response: Eggshell-skull doctrine (Eierschalen-Schädel-Doktrin). Prior damage does not reduce the claim — the causal contribution of the current accident is to be assessed independently.

Frequently Asked Questions

What is Wertminderung? The loss in value of a repaired vehicle on the used-car market because it is declared as "accident-damaged" — even after a fully professional repair. An independent damage position under § 249 BGB.

Can I claim Wertminderung for my 7-year-old car? Possibly — the rule of thumb "no Wertminderung after 5 years" is not a BGH standard. For premium brands, good condition, and brand-authorised servicing, Wertminderung can be established beyond 5 years. Individual assessment by your own Sachverständiger required.

From what damage amount does Wertminderung apply? Typically from €1,500 in repair costs — the minor-damage threshold is not €3,000, as insurers frequently claim. For structural damage, it may apply from lower amounts.

Who calculates the Wertminderung? Your own Sachverständiger in the Gutachten, using recognised methods (Ruhkopf-Sahm, Halbgewachs, MFM). Insurer Gutachten tend to set Wertminderung significantly lower.

What does the Gutachten cost? In a no-fault accident the insurer pays — see Sachverständigen-Kosten.

Is litigation worthwhile for a refused Wertminderung claim? Typically yes from a difference of €500. Legal costs are borne by the insurer in a no-fault accident, BGH case law on Wertminderung is clearly established — strong prospects for our partner law firm.

If You Are Stuck

Wertminderung disputes are one of the most lucrative areas of claims settlement — differences of €1,000–€3,000 between the insurer's position and what is actually owed are not uncommon. Your own Gutachten plus legal representation by our partner law firm is paid for by the insurer.
