What is a Sicherungsabtretung — and is it safe?

With the Sicherungsabtretung (security assignment) under §398 BGB, the injured party transfers the claim against the opposing insurer — up to the amount of the appraiser's fee — to the appraiser. You sign once; the appraiser then invoices the insurer directly. You pay nothing upfront. This is the industry standard.

How much diminished value can I claim after an accident?

The measurable diminished value (merkantile Wertminderung) according to the Sanden/Danner formula ranges between 500 € and 2,500 €. Rule of thumb: year 1: 25 %, year 2: 20 %, year 3: 15 %, year 4: 10 % of repair costs. No fixed age limit according to BGH VI ZR 357/03.

Am I entitled to a rental car after the accident?

After a non-at-fault accident, yes — under § 249 BGB the opposing liability insurer covers a rental car of comparable class for the duration of the repair or replacement. Alternatively it pays loss-of-use compensation in cash, graded by vehicle group and days off the road. If you drive little, the cash option is often the better deal.

Can I choose my own repair shop?

Yes, free choice of repair shop remains yours. The opposing insurer may not refer you to a partner workshop if you want the repair carried out at a brand-authorised specialist — this applies in particular to newer vehicles or those with a full service history.

What does the 130% rule mean in a total-loss case?

The 130% rule (BGH VI ZR 67/91) allows repair costs of up to 130 % of the replacement value — provided the vehicle is professionally repaired in accordance with the assessment and is used for at least 6 months after.

Warum sind die Straßenbahngleise im Ulmer Straßenraum für Zweiräder ein Risiko?

In Ulm verkehren zwei Straßenbahnlinien: die eine von Söflingen nach Böfingen, die andere über den Eselsberg. Teils liegen die Gleise auf eigenem Bahnkörper, teils im Straßenraum zwischen dem übrigen Verkehr. Für Fahrräder und Motorräder ist die Rille neben dem Schienenkopf die Gefahrenstelle: Wer sie in spitzem Winkel überquert, verliert die Spurführung, und das Vorderrad rutscht hinein. Bei Nässe kommt hinzu, dass der blanke Stahl kaum Kraftschluss bietet. Die Stürze passieren bei geringem Tempo, hinterlassen aber Schäden, die zu prüfen sind: verzogene Gabel, Schlag im Vorderrad, gestauchte Lenkerarmatur. Ob der Rahmen noch fluchtet, entscheidet über die Fahrsicherheit und zeigt sich erst bei der Vermessung.

Was ist an der Böfinger Steige besonders?

Die Strecke an der Böfinger Steige überwindet auf etwa 300 Metern rund 7,7 Prozent Steigung und gehört damit zu den steilsten Straßenbahnabschnitten in Deutschland. Für den Straßenverkehr daneben gilt dieselbe Neigung. Bergab verlängert sich der Bremsweg spürbar, bergauf bleiben Fahrzeuge bei Glätte stehen und rollen beim Anfahren zurück. In Ulm treffen an solchen Stellen im Winter Streusalz, Restnässe und starkes Gefälle zusammen. Auffahrunfälle laufen hier mit einer Besonderheit ab: Das auffahrende Fahrzeug bremst bereits, die Front taucht ein, und der Anstoß trifft tiefer als sonst. Deshalb ist unterhalb des Stoßfängers zu prüfen, ob Querträger, Kühlerbefestigung und Klimakondensator Druck bekommen haben.

Warum bündelt sich der Verkehr nach Neu-Ulm auf wenigen Brücken?

Die Donau trennt Ulm vom bayerischen Neu-Ulm, und der gesamte Verkehr zwischen beiden Städten läuft über eine überschaubare Zahl von Brücken. Auf diesen Querungen treffen Berufs-, Einkaufs- und Durchgangsverkehr zusammen, dazu Radfahrer und Fußgänger auf schmalen Seitenanlagen.
