Accident without fault — what you are entitled to now

Anyone not at fault for an accident has the right to full restoration (§ 249 BGB). From the expert report to pain and suffering compensation, the opposing liability insurer covers everything — 0 € out of pocket for you.

The principle: you should be in the same position as if the accident never happened

§ 249 BGB requires Naturalrestitution — the full restoration of your pre-accident situation. This gives rise to your individual claims, as well as three important freedoms: free choice of expert, free choice of repair shop (BGH VI ZR 53/09), and free choice of lawyer. No one may refer you to the insurer's appraiser or their "partner network."
